Privacy Policy

In accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 (hereinafter referred to as "GDPR"), this Privacy Policy aims to inform individuals who visit or use the website “http://www.amhospitality.yellenge.nl (hereinafter referred to as the "Website") about the processing of their personal data.

For the purposes of this Privacy Policy, "User" or "Users" shall be understood as any category of individuals included in this policy. 
 

1. Who is the data controller? 

The data controller for the processing of your personal data is BELLA MENTE QUANTUM RACING Association, with Tax Identification Number G72791189, and registered address at Poligono Joan De Borbo Comte De Barcelona 92 08039, Barcelona -Spain (hereinafter referred to as " NYYC American Magic", “Controller” or "we").

2. When do we collect your personal data, and what types of personal data do we process?

If you’re the contact person requesting our Hospitality Experiences for you and/or for your group (hereinafter referred to as “Group Manager” or “Contact Person”), we will collect your personal data directly through our “Registration – Request your NYYC American Magic Hospitality Experiences” form enabled on our Website.

If you’re an attendee enjoying our hospitality packages and experiences, your personal data will be collected indirectly through the form provided by your Group Manager when filling out the relevant request form for the hospitality experience for your group. 

Also, we may obtain your personal data when you contact us by sending an email to hospitality@americanmagic.com.

As for the types of personal data, we will only process the personal data shared through the aforementioned forms or when you send us an email to our contact email address, such as: 

  • The first and last name, email address, and phone number of the company's Contact Person requesting our Hospitality Experiences.

  • The first and last name, contact phone number when requesting Casa de American Magic and/or Skybox Experiences, and he first and last name, contact phone number and ID number when requesting Team Base Experiences, of the group attendees whose data are provided by the Group Manager who requested our Hospitality Experiences. 
     

3. For what purpose and legal basis do we process your personal data? 

If you're the Contact Person requesting our Hospitality Experiences for yourself and/or your group, we will process your personal data to manage your request and registration through the provided forms intended for booking our hospitality packages and experiences.

The legal basis for processing the personal data of the Contact Person is the legitimate interests pursued by both the company they represent and ours to obtain and provide information regarding our Hospitality Experiences (article 6.1.f) of the GDPR). 

If you’re an attendee enjoying our hospitality packages and experiences, your information will be processed to manage your attendance and participation in our events and activities. This includes, among other arrangements, booking and sending the tickets for the event(s) and venue(s), sending you all the necessary information regarding your package(s) and experience(s), creating attendance lists, and obtaining the necessary accreditations.

The legal basis for processing the personal data of attendees is the consent that they have previously granted to the company, which has required the hospitality experiences through the Contact Person’s request (Article 6.1.a) of the GDPR). 
 

4. How long will be retain your personal data? 

Your personal data will be processed for the duration necessary to fulfil the purposes established in this Privacy Policy (i.e., the end of the contractual relationship), as well as to retain your personal information in compliance with relevant laws and regulations, particularly concerning legal statutes of limitations, and for the formulation, exercise, or defence of claims.


5. To whom will we disclose your personal data?

Your personal data may be disclosed to third parties in compliance with legal obligations that may apply in each case, such as to Public Administrations and/or Organizations when required by tax, labour, Social Security regulations, or any other applicable laws.

If you’re an attendee enjoying our hospitality offerings and packages at our Team Base, your personal data will be disclosed to MB92, Barcelona’s Port Management company, for the purpose of registering you to obtain the necessary accreditation as a visitor to access the base.


6. What are your rights when you provide us with your personal data?

We inform you that you can exercise the following rights: 

  • Right to request access to personal data: You have the right to check whether your personal data is being processed and, if so, receive a copy of the personal data we hold about you.

  • Right to request the rectification of your data in case they are inaccurate or to request data to be completed if they are incomplete.

  • Right to request the erasure of your data. You have the right to request the erasure of your personal data in cases where your data is no longer needed for the purpose for which it was collected, you withdraw your consent (if consent is the legal basis for processing), you object and there are no overriding legitimate grounds for the processing, your data is processed unlawfully, or erasure is required to comply with a legal obligation. However, this right is not unlimited and may not apply in certain circumstances.

  • Right to request the restriction of processing: in this case, NYYC American Magic Hospitality will only keep data for exercising or defending against claims.

  • Right to object to the processing: we will cease to process your personal data, unless they must continue to be processed for legitimate reasons or for exercising or defending against possible claims.

  • Right to data portability: if you would like your data to be processed by another data controller, we will facilitate the transfer of your data to the new controller, if technically possible.

  • Right to withdraw consent at any time. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.

We inform you that NYYC American Magic Hospitality does not carry out any automated decision-making regarding your personal data. 

You can exercise your rights via email through gdpr@americanmagic.com. Our goal is to assist you whenever you wish to exercise your rights, although in some cases, we may have legitimate reasons to deny your request.

We will consider your request and provide a response within one month of its receipt. However, we may extend this period by an additional two months, if necessary, in cases where more time is needed for a proper response (e.g., if the request is complex). In any case, we will inform you of the reasons for any delay. If we decide not to take action on your request, we will also inform you of the reasons for our decision.

If you disagree with the decision made regarding your request to exercise your rights or if you’ve any complaints, you can lodge a complaint before the Spanish Data Protection Agency (www.aepd.es). 


7. Additional information:

Personal data of attendees: If you are the Contact Person making the request and you disclose/share personal data of attendees from your group, you guarantee that the company you represent, or for which you act as the Contact Person, has provided this Privacy Policy and/or its content to the attendees whose personal data is being shared with us, and that the company you represent, or for which you act as the Contact Person, has obtained explicit consent from the attendees to disclose their personal information to NYYC American Magic. 

Privacy Policy updates: we may update this Privacy Policy from time to time to reflect changes in how we process personal data or to clarify certain information provided in this Privacy Policy. For this reason, we recommend to periodically review this Privacy Policy. However, we will directly notify you of any substantial changes to it or how we use your personal data, whenever the law requires us to do so.
